1 Course Description

  1. Series Lectures On Chinese Culture

  This course is about Chinese culture.It consists of several lectures:geographical environment、history、traditional Chinese philosophy、Chinese nationality、traditional Chinese medicine、traditional Chinese festivals、science and technology of ancient China、Chinese catering、tea and martial culture, etc.

  By learning China's geographical environment and history,students will know the formation and development of China; by learning traditional Chinese philosophy and ideologists, students can understand  the spirit world and cultural personality of Chinese people; by learning traditional Chinese festivals、drama and martial culture, science and technology of China,students will know the smart and elegant Chinese wisdom ,and the daily life custom of Chinese people.

  

  2.Chinese Traditional Legal Culture

  Chinese culture  is of rich contents and different forms.This course, matching other courses of Chinese law focuses on the core ideas of Chinese culture behind Chinese legal system such as Chinese philosophy, the humanistic spirit Chinese religions and Chinese traditional legal culture etc.

  The goals of This course: it is aimed to enable students to: 1. understand the characters of Chinese people and their cultural background. 2. understand the major components of Chinese traditional culture. 3.understand the difference,conflict and  integration of Chinese and western cultures.

  

  3.Marketing from a Cross-cultural Perspective

  This course is aimed at the international students. And with the fostering of intercultural communicative ability in business oriented towards Chinese market as the thread, with the imparting of legal, managerial, financial and taxation knowledge lending itself to doing business in China as the basis, with the improving of marketing capability in a pluralistic Chinese characteristic market as the direction, with the promoting of the ability to assimilate into the local market and to engage in localized competition as the objective, this course is intended to help the students, as would-be businessmen, find a desirable foothold and equip them with clear ideas and tangible aims in the Chinese market.

  

  4.Ancient Chinese Mythology

  This course is designed to have the students enjoy Chinese mythology and mythological tales and lead them into the wonderland of Chinese literature via the teacher’s introduction of the texts and comparison with related western literature. By doing so the students are expected to have a good knowledge of Chinese literature and simultaneously appreciate the unique charm of this literature.

  

  5.Cross-cultural Communication

  This course adopts the teaching form of classroom teaching and simulation scene. Through the interpretation of cultural phenomenon, the introduction of cultural model and the combing of cultural theory, it instructs students how to communicate efficiently with people from different cultural backgrounds. Improve their intercultural communication skills.

  Before each class begins, the course adds a "Warm up Cases", through carefully arranged reading texts, situational simulations, and even varieties of film, television show, and even online video clips, etc., by the teaching team. The conflict between Chinese and western cultures in various situations is shown intuitively, which leads to the main teaching contents of each lesson. At the same time, the teaching team carefully prepared the reading and viewing materials after class.

  

  6. Marketing finance and human resource management

  This course mainly introduces the basic theory and knowledge, and the characteristics, practice and possible problems involved in doing business in China. The course content consists of the analysis of China’s commercial market, the practice and application of business theories in China’s commercial market, including marketing management, financial management, and human resource management. This course helps students understand the new trends and frontier theories of Chinese business, combines classic and latest cases, cultivates students’ ability to acquire new knowledge, and prepares them for future business operations and exchanges in China.

  

  7.The Law of International Trade Transactions

  The field of International Trade Law is extremely wide. It encompasses both private and public law elements and it is likely that each course offered by different institutions and different lecturers in this subject will have different emphasis. This course will not cover both the private and public law aspects of international trade. It will accordingly omit the public law aspects that come into play especially since the establishment of the World Trade Organization, but seek to focus on the practical contractual aspects of international trade, which would address the practical need of a practitioner advising a client who, for instance, has a product to export to various countries abroad.

  The first main objective of this course is to give students a good overview of the legal aspects relating to international trade transactions. The second objective of this course is to provide students with the knowledge and skill to know which legal principles may be relevant, and where to obtain the relevant material. The third objective of this course is to develop the practical skills of students to take part in international trade transactions.

  

  8. Introduction to Chinese Legal System

  Introduction to Chinese Legal System aims at international students in China, providing a global view on current Chinese legal system and distinctive features. This course is designed to approach the topic from three dimensions: 1. Chinese legal system, construction of nomocracy and society ruled by law, legislation, jurisdiction and law enforcement, 2. constitutional-based legal system, 3. legal supervision, services and education with Chinese characteristics, China’s domestic law in international society. Students are expected to be able to analyze Chinese social and economic hot events, and have an overall and objective understanding of the achievements in China's construction of nomocracy since 1949.

  

  9.Chinese Economy

  In the more than 60 years since the founding of the People's Republic of China(PRC) in 1949, China has undergone an unusual and tumultuous development process, passing through a series of economic reform, and then achieve rapid economic growth. As the largest developing country, learning the successful experience of its economic development is an important reference for other developing countries, at the same time, as the world's second largest economy in the world, Chinese economy is also a hot topic.This course aims to introduce the current situation of economy, cause the attention of students to the Chinese economy phenomenon and thinking, and at the same time mastering a certain economic basis is helpful for other courses of study.

  

  10.Geography of China 

  This course helps students understand the global conception of China's geography and its meanings. And students are supposed to: (1) learn the features and structure of geographical environment of China; (2) understand the basic process of formation and evolution of geographical environment; (3) know the region division of China and (4) compare the relationship of population, resource, environment and development of typical regions in China and the students' own countries.

  

  11.International Intellectual Property Law

  This course aims to introduce students some basic theories, rules and regulations of international protection of intellectual property rights, as well as frontier issues and latest developments, so as to enable students to master the legal systems and mechanisms of international intellectual property system and to cultivate students academic innovation capabilities. At the same time, by adopting  multi-media teaching, interdisciplinary, cross-departmental and even cross-border teaching and IP teacher joint teaching, this course also promotes students' ability to communicate in foreign languages, as well as their ability to think, analyze and solve problems through lectures, interactions, and discussions.

  

  12.Introduction to Chinese Civil Law

  This course covers the civil law system in People's Republic of China, including the basic structures of China's Civil Law, Property Law, Obligation Law and Tort Law etc.. In the first semester, we will learn the general principles of the civil law and the contract law. Reading assignments focus on laws and regulations as well as cases in Grassroots People's Courts, which interpret how the laws and regulations should be applied in legal practice. Students are required to do some commentary writing and discuss topics on China's civil law and its judicial practice in and after lectures.

  

  13. International Trade Law Case Studying

  This course is divided into two parts. The first part aims to consider and discuss some cases in terms of the topics under the framework of WTO. It covers the topics of MFN, service, IP, environment, etc. The second part aims to interpret the articles in CISG convention and discuss related cases.

  During this course, the students may study cases on the following aspects:

  The MFN & the National Treatment Principle in WTO

  Antidumping & Competition &Subsidies & Countervailing Duties in WTO

  Formation of international commercial contracts in CISG

  Damages in breaching of contracts in CISG

  Rights and obligations of sellers and buyers in CISG

  

  14.Public Safety in China

  Criminology is not only a basic theoretical subject but also a practical subject. This course conducts an in-depth study on the phenomena, causes and prevention of crimes. Using the knowledge of law (criminal law, criminal investigation, prison science), sociology, politics, economics, psychology, biology and other disciplines, systematically analyze the current situation and characteristics of criminal activities, explore its laws and causes, and predict the development trend. The course also presents methods and strategies for crime prevention and control.

  

  15.The operation and management of Chinese multinational corporations

  This course mainly introduces the basic theory and knowledge of multinational operation and management. It involves the general rules and practices of the development of transnational corporations, basic theories and methods of international trade and investment, environmental analysis of international operations, theories and methods of strategic management, marketing management, human resource management, cross-cultural management, etc.

  This course helps students understand the oretical content of transnational operation and management. The course will help students master practical knowledge related to transnational operation and management, to cultivate students' practical ability, so that students can apply theoretical knowledge in practice

  

  16.Chinese Company Law

  This course is aimed at those who are interested in Chinese Company law. Given that students taking the course may have various level of knowledge on Chinese Company Law and different legal experiences, no previous knowledge of company law or financial market regulation or background in economic theory is required for those wishing to follow this course. It provides a good background for further study of Chinese commercial law and financial market regulation. As such, the course will be taught at an intermediate level.

  

  17.Case Analysis of Public International Law

  International justice is developed through the constant practice of Public International Law (PIL), which provides the technical and intellectual underpinnings to large areas of international cooperation. This course aims at those who are interested in the settlement of international disputes and wish to know the practice of PIL in China. Based on theories and classic PIL cases, it offers an examination of state and jurisdiction, the settlement of land and maritime boundary disputes, and international environmental law. Given that students who participate in the course may have various levels of knowledge on law, the course will be taught at an intermediate level, and no previous PIL experience is required. The course covers a large number of international law terminology and provides a necessary background for further study of international law.

  

  18.Finance Law

  Finance law(English) is a course for foreign students of SWUPL whose majors are legal science, economics and management. This course examines the legal approach to dealing with risk and provides an understanding of the essential elements of financial law. It involves the study of the objectives of financial law, the framework of financial law, the financial legal relationship, financial institutional law, financial market law(especially security law and instrument law), financial supervision law.

  Educational highlights:

  Understand the intention and extension of financial law, master the basic categories of finance law (banking law, instrument law, security law, insurance law) and their fundamental principles, fundamental institutions and major rules. Understand the reform background of Chinese finance law and its typical cases.

  

  19. Chinese Intellectual Property Law

  This course provides an introduction to the general theories and legal provisions of the Chinese intellectual property law. Students will study the fundamental legal principles and statutory provisions in the fields of copyright, patents, and trademarks  in China. The course will explain the origins, nature and scope of these intellectual property rights, the procedure for obtaining or granting the rights, as well as the legal protection against piracy and other infringements.

  

  20.Corporate Finance

  The course studies key issues in corporate finance from the perspective of chief financial managers who are responsible for making significant investment and financing decisions. We will consider corporate investment decision (i.e. project valuation) and decision that involve financing those investment (i.e. capital structure and fund raising), which touching on related issues in risk management, corporate governance, and financial system. In essence, we will explore the very patterns of corporate finance that has shaped the familiar yet complex terrain of today's global economy. An equally important component of this course is its emphasis on developing your critical auditory and erudite writing skills to a level that is commensurate with university standards. The course teaching methodologies will be composed of lectures, assignments and one group project.

  

  21. Chinese Economic Law

  Economic law is the basic legal form to confirm and regulate state intervention in economy. It is an important legal department in China's legal system, and also is one of the basic and core courses for law school students. Economic law is the general legal system that regulates economic relations requiring state intervention, including market entity regulation, market order regulation, macroeconomic regulation and economic supervision relationship. Economic law contains four parts, namely, legal system of enterprise organization management, market order law system, macroeconomic law system and economic supervision law system.

  

  22.International News Reporting

  The deadliest wars of the 20th century have been far and away from us. Yet regional conflicts are still lingering around the world. It is the goal for this course to achieve that you need to enhance your professional skills in a global context, to observe closely the world affairs, and to think and act for the future of journalism. During the next 9 weeks, we will not only study together why and how the international news is important, the intercultural communication problems that a global journalist may come across, but also analyze the world news from different news outlets, and discuss the ethics and norms of international journalism. Following the footsteps of earlier foreign correspondents into exotic scenarios and even hostile conditions, we may feel the heartbeats of international news reporting.

  

  23.Introduction to China's Legal System

  The Introduction of Chinese legal system is the advanced course of the Basic Theory of Law offered to graduate students. It aims, through in-depth studies and analysis of the basic principles and the fundamental spirits of Chinese law, to bring students into a more rational understanding of Chinese law, based on their knowledge of various branches of law, and the rationales and value orientation or Chinese legal cultures behind law. The course covers theories of legal justice, legal values, legal methodologies, legal analysis of Chinese society, as well as the development of major contemporary legal thoughts in China. Additionally, some Hot Topics about the legal events in current China in processing of rule of law are also given to the familiarize students with theories of law above through lectures, discussions and essay writing for the purpose of fostering their capabilities of independent thinking and critiques, research and resolving problems and ultimately realizing integrated development of legal skills.

  

  24.Chinese Criminal Law and Criminal Procedure Law

  The course is the compulsory courses of Chinese law program by SWUPL,which falls into six special topics and covers the most part of Chinese criminal law and criminal procedure law.

  The purposes of this course are to trace the history of Chinese criminal law and criminal procedure law briefly, make students feel the pulse of Chinese criminal culture, understand the basic principles of Chinese criminal law and criminal procedure law such as the principle of legality, innocent presumption and Chinese criminal justice,explore and discover the limit of criminalization in China, compare and reflect on the elements of crime ,understand the death penalty system and its procedure,enhance the practical ability to use the evidence to adjudication. At the same time,you'll enjoy the flipped class and interact with humorous professor personally.

  

  25.Chinese Contract Law

  Contract law is trade law. Understanding Chinese contract law is helpful for foreign students to grasp the regulations of Chinese economic and trade law.

  Course Objectives:

  1.General level :Carrying out proposals of “One Belt One Road” for educational exchange;

  2.Specific level :Strengthening foreign students’ understanding of Chinese Contract Law.

  Course Contents:

  1.Basic principles, legal system and judicial overview of Chinese contract law;

  2.Comparison with the basic ideas of and the specific system of Anglo American Contract Law.

 

  26.Human Rights Protection and Development in Modern China

  The Chinese human rights story we tell in this course begins with the introduction of the modern Western concept of human rights into China. In modern times, the western concept of human rights was introduced into China and accepted by the Chinese people. However, the Chinese concept of human rights was not completely clear, but had its inherent cultural root. Moreover, while accepting the western concept of human rights, China also reshaped its discourse connotation and practical logic, thus forming the expression and realization of human rights discourse with Chinese characteristics.

  Teaching Objectives:

  1. Understand the historical changes of China's contemporary human rights concept and the inheritance and characteristics of Chinese and Western human rights legal systems;

  2. Understand the protection of human rights in The process of Comprehensively advancing the rule of law in China;

  3. To master China's existing protection mechanisms for the rights of women, children, the disabled, the elderly and emerging rights;

  4. To understand the formation of the public concept of human rights in China;

  5. Recognize the National Human rights Action Plan of China and the development and progress of the human rights cause in China;

  6.Conduct discussions on the theme of China's Human rights and a Community with a Shared future for mankind.

  

  27.China's Economic Policies and Practices

This course aims to introduce the current situation of economy, causing the attention of students to the Chinese economy phenomenon and thinking, and at the same time mastering a certain economic basis is helpful for other courses of study.

  This course aims to make foreign students fully and systematically understand the he development process of Chinese economy and be familiar with the Chinese economic development nowadays. It also aims to make foreign students know the breakthrough of the Chinese economy and the challenge still existing, and cultivate the ability of students of using the economics method to research on the reform of the system of Chinese market economy and realistic problems related to Chinese economy.

  For language studying:  

  Open to students from cooperative universities who apply for language courses offered by the school of International Education, SWUPL.

  For studying professional courses:

  Students taking professional courses taught in Chinese should have a new HSK4 certificate (mark 180 or above), or the equivalent language proficiency certificate. Students taking courses taught in English shall submit certificate of English proficiency. (For non-English speaking countries)

  

  Arrangement of Courses

  There are 4-5 types of Law courses, 2-3 Economics courses, 2-3 Chinese Cultural courses and 3-4 Chinese Language courses each semester. And there are also field trips for exchange students.

4 Chinese Language Program(Non-Degree Program)

  Project target:

  Non-Chinese citizen, Age 18-35, Be healthy, High school graduation or above educational background, Holding a valid foreign passport

 

  Profile of the program:

  SWUPL provides various levels of Chinese language courses for foreign students all the year round. International students can choose primary, intermediate or advanced courses according to their needs. Students will be awarded a certificate of completion when they complete all courses and pass the examination.

 

  Main courses:

  Comprehensive Chinese; Chinese speaking; Chinese Writing; Chinese Reading; Chinese painting & calligraphy; Traditional Chinese Music; Kungfu (Chinese martial art); Others.

5 Preparatory Program (Non-Degree Program)

  The Preparatory Program has a schooling system of 1 year, including pre-undergraduate and pre-master program. Program students will take full-time Chinese language courses. Those who pass HSK4 or HSK5 successfully after one year can apply for undergraduate or master program. 

 

  Application requirements

  Applicants should be foreign students with a senior high school diploma or university diploma, and should be no younger than 16 years old. Applicants should be in good health, be virtuous, be willing to abide by the laws and decrees of China and the rules and regulations of Southwest University of Political Science and Law, and respect Chinese traditions, customs, and social morality. Applicants for pre-master program should hold the valid certificate of HSK3 or above.

6 Doctor Program in Human Rights Law ( Degree Program)

  (1)Eligibility Requirements for Applicants and Number of Students to Be Enrolled

  • Eligibility Requirements for Applicants: foreign nationals with a master's degree or a higher degree, who should have a second moral character, be healthy and free of any records of criminal offence or bad credit records both in their home country and in China, and have reliable financial support and a guarantor for their affairs in China. The educational diplomas held by the applicants are subject to certification by the Accreditation Center of the Ministry of Education of the People's Republic of China or notarized by a competent authority. Applicants who apply for a program that is mainly taught in Chinese should have the Chinese language proficiency necessary for daily communication, study and academic research; applicants for a program mainly taught in English should have the English language proficiency necessary for daily communication, study and academic research.

  • Program Length: the standard length of the program is three years. The length may be extended to six years maximally for students who fail to graduate or pass the dissertation defense by the end of the standard 3-year length of the program.

  

  (4)Required Application Materials

  • International Students Admission Application Form of Southwest University of Political Science and Law, which should be property filled in.

  • A photocopy of Graduation Diploma and Degree Diploma, and the original of the Accreditation Certificate or Notarial Certificate (whichever is applicable) of the diplomas;

  • Academic Transcript of all undergraduate and master courses (both the original and notarial certificate);

  • Personal Statement (including a curriculum vitae and a research plan); (Approximately 1,000 words for Master’s Degree Program applicants, and around 2,000 words for Doctor’s Degree applicants).

  • Academic achievements, including a list of published academic papers and their abstracts, and other original academic achievements;

  • Recommendations letters (please refer to AppendixⅡ) by two professors (or persons of equivalent qualifications) in a discipline that is the same as or similar to the discipline that the program applied for is under.

  • A Doctoral Study Plan of 2,000 to 3,000 words, which should specify the orientation, field, plan and arrangement of the proposed research.

  • Applicants for a program mainly taught in Chinese should provide their HSK (Hanyu Shuiping Kaoshi, or Chinese Language Proficiency Test) , Test Score Certificate for the HSK Test that the applicant took within the past two years; applicants for a program mainly taught in English should provide a certificate of their IELTS or TOEFL score (this certificate is not required for applicants from a country where is the mother tongue or official language).

  • A photocopy of their passport, and eight passport photos;

  • The Physical Examination Report for Foreign Nationals (which should be issued by a public hospital in the home country of the applicants or by a tertiary hospital in China, and should be duly stamped by the hospital and affixed with a recent photo of the applicant. Applicants may also opy to undergo a physical examination organized by the local health and quarantine department after they arrive at SWUPL).

  • Applicants for a program mainly taught in Chinese should provide a Chinese version of the above materials; applicants for a program mainly taught in English should provide both a Chinese version and an English version of the above materials.

  

  (5)Examination Subjects

  • Written Examinations The written examinations cover two disciplinary subjects, namely, Theory and Practice of Human Rights, and International Human Rights Law. Each examination will last for three hours and the full score is 100 marks for each subject.

  • Interview The interview is intended as a comprehensive assessment of the applicants’ essential academic performance in the academic discipline that the program they apply for is under, their overall competence and language proficiency. In the interview, the applicants will be required to make a presentation to the interview panel, which should include an introduction to their academic research history and achievements, their understanding and perception of the academic discipline in which the program they apply for is involved, and their study and research plan, among others.   (6)Admission

  • Applicants who pass the entrance examinations, and whose academic competence and language proficiency meet the standards required by the Doctor’s Degree Program they apply for will be admitted.

  • A list of applicants who are admitted will be released on the specified website after review and approval by the competent authority in charge of the SWUPL HRI. After that, an admission notice will be delivered to each of the admitted applicants.

  

  (7)Diploma and Degree     

  Students who pass the examinations of all the courses in the curriculum of the Doctor’s Degree Program they are admitted to as well as the graduation dissertation defense will be awarded with the Graduation Diploma and Diploma of Doctor’s Degree.

  

  (8)Attendance Requirements

  The program consists of six semesters. Of the six semesters, the first and second ones are devoted to in-class instructions, which will last for at least one month each semester. During each of the fourth, fifth and sixth semesters, the students should go to the SWUPL HRI at least once, to attend a study and discussion session that lasts for at least half a month. Furthermore, students should go to the SWUPL HRI graduation dissertation proposal defense and graduation dissertation defense.

7 LLM in Chinese Law ( Degree Program)

  The LL.M. (Master of Laws) program is a two-year degree program taught in English that focus both on the educational and professional experiences of the international students.

  

  About the program

  I. Program Objectives1. Applicants for the LL.M. program should be overseas students or law professionals with a bachelor's degree who are keen on learning about Chinese law, experiencing multi-culture, and to be engaged in research on Chinese law and comparative law. 2. Students in LL.M. program are provided with opportunities to gain an in-depth understanding of Chinese legal system, history and culture, and a business environment relevant to international legal system. 3. 8 Master Program in Human Rights Law( Degree Program)

  The Human Rights Institute of Southwest University of Political Science and Law (SWUPL HRI) is a national human rights education and training center of China. As an integral department of the Southwest University of Political Science and Law(SWUPL). SWUPL HRI offers a PhD program and a master's degree Program in “Human Rights Law”.

 

  (1) Eligibility Requirements for Applicants and Number of Students to Be Enrolled     

  • Eligibility Requirements for Applicants: foreign nationals with a bachelor's degree or a higher degree, who should be healthy, have a sound moral character, be free of any records of criminal offence or bad credit records both in their home country and in China, and have reliable financial support and a guarantor for their affairs in China. The education diplomas held by the applicants are subject to certification by the Accreditation Center of the Ministry of Education of the People's Republic of China or notarized by a competent authority. Applicants who apply for a program that is mainly taught in Chinese should have the Chinese language proficiency necessary for daily communication, study and academic research; applicants for a program mainly taught in English should have the English language proficiency necessary for daily communication, study and academic research.

  • Applicants for a program mainly taught in Chinese should provide their HSK (Hanyu Shuiping Kaoshi, or Chinese Language Proficiency Test) Test Score Certificate for the HSK Test that the applicant took within the past two years; applicants for a program mainly taught in English should provide a certificate of their IELTS or TOEFL score (this certificate is not required for applicants from a country where English is the mother tongue or official language).

  • A photocopy of passport, and eight passport photos; and The Physical Examination Report for Foreign Nationals (which should be issued by a public hospital in the home country of the applicants or by a tertiary hospital in China, and should be duly stamped by the hospital and affixed with a recent photo of the applicant.      

  • Applicants may also opt to undergo a physical examination organized by the local health and quarantine department after they arrive at SWUPL). Applicants for a program mainly taught in Chinese should provide a Chinese version of the above materials; applicants for a program mainly taught in English should provide both a Chinese version and an English version of the above materials.

  (5) Examination Subjects     

  • Written Examinations

  The written examinations cover two academic subjects, namely, Theory and Practice of Human Rights, and International Human Rights Law. Each examination will last for three hours and the full score is 100 marks for each subject. 

  • Interview 

  The interview is intended as a comprehensive assessment of the applicants’ essential academic performance in the academic discipline that the program they apply for is under, as well as their overall competence and language proficiency. In the interview, the applicants will be required to make a presentation to the interview panel, which should include an introduction to their academic research history and achievements, their understanding and perception of the academic discipline in which the program they apply for is involved, and their study and research plan, among others. The full score for the interview is 100 marks.

10 Undergraduate Program(Degree Program)

  The Undergraduate Program is a full-time four-year schooling program. All the majors are delivered in Chinese. International students can choose different majors ranging from economics to laws. After completing all the credits and finish thesis defense successfully they will be awarded the graduation certificate as well as the bachelor diploma.
